Pancakes with Santa – Terms & Conditions

These Terms and Conditions (“Terms”) govern participation in the Pancakes with Santa event hosted by Beyond the Diagnosis Foundation, Inc. (“the Foundation,” “we,” or “our”). By registering for or attending this event, all participants (“you” or “attendee”) agree to be bound by the following:

1. Event Admission

1.1 Admission includes:

• Free entry for one (1) child with a disability and one (1) parent or legal guardian.
• Up to three (3) additional guests may attend at a cost of $5.00 per guest.

1.2 All attendees must be registered prior to the event. Walk-ins may be denied based on capacity.

1.3 Registration is non-transferable.

2. Payment & Refunds

2.1 Fees collected for additional guests are non-refundable, except in cases where the Foundation cancels the event.

2.2 Payments must be completed at the time of registration. Unpaid registrations may be automatically canceled.

3. Photo & Media Release

3.1 By attending the event, you grant the Foundation permission to photograph, film, or otherwise capture images and recordings of you and your child(ren).

3.2 You authorize the Foundation to use such media for:

• Promotional materials
• Social media content
• Website features
• Fundraising or educational purposes

3.3 If you prefer for you or your child not to be photographed, you must submit this request in writing before the event or notify staff at check-in.

4. Parent/Guardian Responsibility

4.1 A parent or legal guardian must accompany all participating children at all times.

4.2 You are responsible for ensuring your child’s safety and behavior throughout the event.

4.3 You agree to notify the Foundation in advance of:

• Allergies
• Medical concerns
• Behavioral accommodations
• Sensory needs

The Foundation will make reasonable efforts to support accommodations but cannot guarantee all requests will be met.

5. Conduct & Removal

5.1 The Foundation reserves the right to remove any attendee who:

• Disrupts the event
• Causes harm or risk to others
• Fails to comply with staff instructions
• Engages in inappropriate or unsafe behavior

Removal will not result in a refund.

6. Liability Waiver

6.1 By participating in the event, you acknowledge and voluntarily assume all risks associated with:

• Food consumption
• Participation in activities
• Interaction with Santa
• General event attendance

6.2 You agree to release and hold harmless Beyond the Diagnosis Foundation, Inc., its staff, volunteers, partners, and sponsors from any liability for:

• Injury
• Illness
• Allergic reactions
• Property damage
• Lost or stolen items

except in cases of gross negligence.

7. Event Modifications or Cancellation

7.1 The Foundation reserves the right to:

• Modify event activities
• Adjust schedules
• Change venues
• Limit attendance
• Cancel the event due to weather, emergencies, or other circumstances

7.2 In the event of cancellation, registered attendees will be notified via email or posted announcement.

8. Privacy

8.1 Information collected during registration is used solely for event coordination, safety, communication, and reporting purposes.

8.2 The Foundation does not sell or share personal information with third parties.

9. Agreement to Terms

By registering for Pancakes with Santa, you acknowledge that you have read, understood, and agree to these Terms & Conditions.
